Privacy Policy
1. Scope
1.1. This statement discloses the privacy policy (“Privacy Policy”) for www.UtiliSave.com and www.UtilityData.com (collectively, the “Websites”), which are provided by UtiliSave, LLC (“UtiliSave”). This Privacy Policy should be read in conjunction with the applicable Terms and Conditions (or Terms of Service) for the Websites. Any party regardless of its purpose or form of operation that makes use of any elements of the Websites, or ancillary benefits or services shall be considered a user (“User”).
1.2. This Privacy Policy makes disclosures regarding our collection of information, including personal information, and how we use and disclose such information to others. By using the Websites, the User accepts the practices described in this Privacy Policy. This Privacy Policy may be amended, modified or replaced. Any such amendment, modification, or replacement will be effective immediately upon posting.
2. Information We Collect
2.1. We collect personal and non-personal information provided to us by the User in the course of using our Websites. The personal information that we may collect includes the User’s name, email address, and any other information the User may provide through the contact forms on our Websites. For areas of our Websites that are password- protected, Users will be provided with a User ID and a password (“User Data”). The User Data allows the User to view or change its data or, as applicable, to withdraw its consent to data processing. When Users request their User Data, we collect the User’s name, company name, and email address, and any comments provided in the comment section of the User Data request form.
2.2. The non-personal information that we may collect from the User includes browser type, the URL of the previous website visited by the User, ISP, operating system, and Internet protocol (IP) Address. The non-personal information is not used by us to personally identify Users and is not readily usable for that purpose.
2.3. We may use analytic and reporting technologies to record non-personal information such as Internet domain and host names, Internet protocol (IP) addresses, browser software, operating system types, click patterns, and the dates and times that the Websites and our services are accessed by Users. We may in contract with a third party to help us manage, monitor and optimize our Websites and measure the effectiveness of our advertising, communications and use of the Websites. We may use web beacons and cookies (described below) for this purpose.
2.4. A cookie is a small file placed on the hard drive of your computer. Most websites use cookies. We will use cookies to track use of our Websites, provide User’s with a personalized user experience, and to facilitate User log-in experience. A web beacon is an often-transparent graphic image, usually no larger than a 1×1 pixel that is placed on a web page or in an e-mail that is used to monitor the behavior of the user visiting the website or receiving the e-mail. Cookies and web beacons used by us will not be linked to User personal information.
2.5. In addition, we may collect information from the User that is gathered during the course of any communication between the User and UtiliSave regarding the Websites or UtiliSave’s services.
3. Our Use of User Information
3.1. All data provided by Users remains the property of User, but is subject to the term set forth in paragraph 3.2 below.
3.2. By using using the Websites, and their related services or websites, Users give permission and grant a license to all parties authorized by UtiliSave to use all information including, but not limited to, building data, operational data and utility data provided by the User, for the benefit of the User, Users or other parties that make use of Websites or their related websites, as deemed appropriate by UtiliSave.
3.3. UtiliSave reserves the right to disclose User personal information in order to comply with a court order or other legal process.
3.4. The User may at any time request termination of its registration to password-protected areas of the Websites in writing, provided that the deletion will not violate the proper performance of contractual relationships. In such event, UtiliSave will remove all user data and other stored personally identifiable data of the User as soon as these data are no longer needed.
4. How We Protect User Personal Information
4.1. We consider protecting the security of User personal information as very important. We follow generally accepted industry standards to protect personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect User personal information, we do not guarantee absolute security.
4.2. We are not responsible for the unauthorized acts of others and we assume no liability for any disclosure of information due to errors in transmission, unauthorized third party access (such as through hacking) or other acts of third parties, or acts or omissions beyond our reasonable control.
5. Application of Privacy Policy to Third Party Sites
5.1. Users will be able to access third party websites directly from the Websites. This Privacy Policy does not apply when Users access third party websites. We cannot control how third parties may use the personal information disclosed to them, so Users should carefully review privacy policy of any third party website they visit before disclosing their personal information.
6. 6. Children’s Privacy
6.1. It is unlikely that the Websites are used by those under the age of 17. Accordingly, we will not knowingly collect or use any personal information from children that we know to be under the age of 17.
